Disabilities and Reasonable Accommodation Series covers one of the most commonly struggled areas of EEO law involving individuals with disabilities or claims of disability — the accommodation process. Taken in it’s entirety, this series gives you a solid understanding of the key areas of disability law and reasonable accommodation – and how to effectively respond to unique situations.
Course 1: Disability and the Law — explains the basics of disability discrimination law including disability-based harassment – an often overlooked area of the law that is costly to agencies. After completing this course, you’ll be able to:
- Explain the history and intent of the Rehabilitation Act and ADA
- Determine if someone is a "qualified individual with a disability"
- Identify and effectively respond to harassment claims of individuals with disabilities
Course 2: Reasonable Accommodation — explains the legal background and the practical process of how to provide – and or deny – accommodations for disabilities. After completing this course, you’ll be able to:
- Explain the roles of medical information, documentation and examinations in the reasonable accommodation process
- Determine if a request for a reasonable accommodation is coming from a "qualified individual with a disability"
- Apply the interactive process involved when handling accommodation requests
- Avoid compensatory damages by demonstrating that good faith efforts at accommodation were made
Course 3: Disabilities in Hiring and Promotion — provides new practitioners with the guidance needed to advise management in these matters or serves as a refresher for seasoned practitioners. After completing this course, you’ll be able to:
- Understand and apply the legal basis of disparate treatment to the hiring and promotion of individuals with disabilities
- Avoid liability created by introducing disability questions too soon in the hiring process
- Defend agency interests by your understanding limits of obligation to accommodate
Course 4: Physical Disabilities — defines and examines individual physical disabilities and offers proven tips for their successful accommodation. After completing this course, you’ll be able to:
- Explain how chronic illness fits in to the reasonable accommodation process
- Identify the most common accommodations available for the targeted disabilities set forth by the EEOC
- Consider other physical disabilities not on the targeted disabilities list, such as chemical sensitivities
Course 5: Mental and Emotional Disabilities — prepares you to respond to mental and emotional disabilities -- conditions that are often misunderstood. You’ll learn the considerations necessary to determine if an individual’s mental or emotional disability may properly be considered in agency decision-making. Plus, you’ll learn:
- How to avoid discrimination in disciplinary and performance-based actions
- The relationship between addiction, substance abuse and disability
- How to go about determining what reasonable accommodations may be available to those with mental or emotional conditions
- How to properly evaluate whether an employee with a mental disability is a threat to safety by applying an individualized assessment
