  • Apply the grounds for dismissal outlined in the EEOC's regulations, such as failure to state a claim, untimeliness and abuse of process.
  • Recognize the role played by settlements, and how to avoid the pitfalls presented by such issues as a lack of consideration, duress, and the rules of the Older Workers' Benefit Protection Act.
  • Explain how the EEO administrative process relates to discrimination claims raised through the employee relations and labor relations processes.
  • Describe how complaints become certified for class action status and what the practical implications are.
